At Ingenious Parts Procurement, we are committed to supplying quality automotive spare parts and delivering excellent customer service. This Refund and Return Policy complies with the South African Consumer Protection Act (CPA) 68 of 2008 and outlines our terms for refunds, returns, and exchanges.

Ingenious Parts Procurement (“Ingenious,” “we,” “us,” or “our”) strives for complete customer satisfaction. This policy governs the return of automotive spare parts purchased through our website.

1. Eligibility for Refunds and Returns

1.1 General Conditions
We will consider refunds or returns in the following cases:
– Defective or Damaged Goods: The part is faulty or fails to perform as reasonably expected within the applicable warranty period.
– Incorrect Item Supplied: The part delivered does not match the order or the description provided.
– Not Fit for Purpose: The part is unsuitable for the specific purpose clearly communicated to us at the time of purchase (CPA Section 55).
– Non-Delivery: The part was not delivered within a reasonable or agreed timeframe due to our fault.

1.2 Cooling-Off Period
– For direct marketing transactions (as defined in the CPA), you may cancel within 5 business days of receipt.
– For online purchases, the Electronic Communications and Transactions (ECT) Act provides a 7-day cooling-off period from the date of receipt of the goods.
Goods must be unused, in their original packaging, and in a resalable condition. Return shipping costs are borne by the customer.

1.3 Defective Goods (Implied Warranty)
Under CPA Section 56, if a part fails to meet the requirements of Section 55 within 6 months of delivery, you are entitled to return it (at our risk and expense) and choose a repair, replacement, or refund.

1.4 Compatibility
Customers are responsible for verifying part compatibility (vehicle make, model, year, etc.) before purchase. Refunds will not be granted for incompatibility unless we provided incorrect advice or information.

1.5 Exclusions
Refunds and returns are not available for:
– Parts marked “Final Sale”, “As-Is”, or clearance items (where clearly disclosed).
– Damage caused by misuse, improper installation, or failure to follow manufacturer instructions.
– Special-order or imported parts (unless defective or incorrectly supplied).
– Electrical and electronic components (e.g., alternators, starters, sensors, wiring harnesses, ECUs) once fitted, tested, or installed.
– Used parts or core charges (unless the core is returned in acceptable condition).
– Items damaged during return transit.
– Any goods that are not in their original, unused, and resalable condition.

2. Return Process

2.1 How to Request a Return
– Contact us at support@ingeniouspartsprocurement.com within the applicable timeframe.
– Provide your order number, proof of purchase (Tax Invoice), and photos of the issue (where applicable).
– We will issue a Return Authorisation (RA) number if the return is approved.

2.2 Return Requirements
– Parts must be returned unused (except for reasonable fitment testing), in their original packaging, with all accessories and manuals.
– All returns are subject to inspection upon receipt.
– Return shipping is at the customer’s expense (except where the return is due to our error or a defect covered under CPA Section 56).

2.3 Inspection and Approval
We will inspect returned items within 10 business days of receipt. Refunds may be denied if the item does not meet the eligibility criteria.

2.4 Refund Processing
– Approved refunds will be issued to the original payment method within 10–15 business days of approval.
– Original shipping fees are refundable only if the return is due to our error or a qualifying defect.
– Store credit or replacement (subject to availability) may be offered as an alternative.

3. Warranties
– All parts carry the manufacturer’s warranty (where applicable) in addition to the implied warranty under the CPA.
– Warranty claims must be supported by proof of purchase and evidence of the defect.

4. Limitations of Liability
– We are not liable for delays caused by force majeure events (e.g., load shedding, strikes, courier disruptions).
– We are not liable for damage occurring during transit (initial delivery or return). Customers must inspect goods immediately upon delivery and report any damage to the courier and us within 24 hours.

5. General
– All returns must be accompanied by the original Tax Invoice and a completed return form (where provided).
– We reserve the right to update this policy. Changes apply to purchases made after the updated policy is published on our website.
– Any disputes will first be handled directly with us. Unresolved matters may be referred to the National Consumer Commission (NCC).
