Terms and Conditions
General Terms
These Terms and Conditions (“Terms”) govern the sale of automotive spare parts (“Products”) supplied by Ingenious Parts Procurement (“Supplier”) to the customer (“Customer”). By placing an order, the Customer agrees to be bound by these Terms.
All sales are subject to these Conditions of Sale and the Consumer Protection Act 68 of 2008 (as amended). These terms apply to all purchases of goods, including custom, ingenious, or specially procured parts.
Procurement of Parts
We offer flexible and ingenious parts procurement solutions, including sourcing rare, custom, or specialised components to meet your specific requirements. Where parts are custom-sourced or made-to-order based on your specifications, they may be non-cancellable and non-returnable except as required by law (e.g., in cases of defect or non-conformity). We will confirm any special procurement terms before finalising the order.
- Orders
1.1 All orders are subject to acceptance by the Supplier.
1.2 The Customer is responsible for providing accurate and complete information when placing an order.
1.3 The Supplier reserves the right to refuse or cancel any order at its discretion.
2. Services
2.1 Ingenious Parts Procurement offers a platform for procuring automotive parts within South Africa. Our services include, but are not limited to, facilitating the purchase, sale, and delivery of automotive parts.
2.2 We do not manufacture or directly supply automotive parts; rather, we connect buyers with sellers and facilitate transactions.
3. Ordering and Purchasing
3.1 By placing an order through our website, you are making an offer to purchase the specified automotive parts at the listed price, subject to these Terms.
3.2 Acceptance of the requested pro forma in writing constitutes an offer to purchase the specified automotive parts at the quoted price, subject to these Terms.
3.3 All orders are subject to acceptance by the seller. We reserve the right to refuse or cancel any order for reasons including, but not limited to, availability, pricing errors, or suspicion of fraudulent activity.
3.4 Prices listed on the website are in South African Rand (ZAR) and exclude applicable taxes and shipping, courier, or delivery fees unless otherwise stated.

Errors and Omissions
We reserve the right to correct any typographical, clerical, or other inadvertent errors or omissions in product descriptions, specifications, pricing, or quotations without liability, and may cancel or amend affected orders accordingly, in line with applicable law including the Consumer Protection Act.
4. Pricing and Payment
4.1 Prices are quoted in South African Rand (ZAR) and exclude taxes, shipping, and handling charges unless stated otherwise.
4.2 Payment is due at the time of order unless a credit agreement has been established.
4.3 The Supplier reserves the right to change prices at any time, though prices remain fixed once an order is accepted.
5. Shipping/Courier/Delivery
5.1 Delivery times are estimates and not guaranteed. The Supplier is not liable for delays caused by unforeseen circumstances or third-party logistics providers.
5.2 The Customer is responsible for inspecting the Products upon delivery and must notify the Supplier of any damages, shortages, or discrepancies within two (2) days of receipt.
6. Warranty
6.1 The Supplier offers a warranty on Products as specified by the manufacturer. The warranty period commences from the date of delivery and covers defects in materials and workmanship.
6.2 Warranty claims must be accompanied by proof of purchase and any required product information. The Supplier will either repair or replace defective parts at its discretion.
6.3 The warranty does not cover damage resulting from improper installation, misuse, external factors unrelated to manufacturing defects, or electrical replacement items.
7. Returns and Refunds
7.1 Our returns and refunds policy is governed by our Return Policy, which forms part of these Terms.
7.2 Products may be returned within seven (7) days of receipt, provided they are unused, in their original packaging, and in resalable condition.
7.3 Refunds will be issued to the original payment method following inspection and approval of the returned Products.
7.4 No general right of return for change of mind: Except where required by the Consumer Protection Act, no returns are accepted for reasons such as change of mind, incorrect selection, or buyer’s remorse. This applies particularly to custom, ingenious, or specially procured parts.
Statutory return rights under the CPA
- If the goods were supplied following direct marketing (e.g., unsolicited contact), you may cancel the transaction without reason or penalty within 5 business days after the later of the agreement date or delivery date. You must notify us in writing or another recordable manner within this period. Goods must then be returned within 10 business days of delivery, at your risk and expense (unless otherwise provided by law). We will refund any payments received within 15 business days of receiving your cancellation notice or the returned goods.
- If you communicated a specific purpose for the goods and we confirmed they would meet that purpose, but they prove unsuitable, you may return them within 10 business days after delivery for a refund (or other remedy), provided the goods are unused and in resaleable condition.
- If the goods fail to comply with the implied warranty of quality (Section 55 of the CPA) — e.g., they are unsafe, defective, not of good quality, or not reasonably suitable/durable for normal use — you may return them within 6 months after delivery, at our risk and expense. You may then elect repair, replacement, or refund.
- All returns must be authorised in advance. Goods must be returned in their original condition and packaging (where reasonable), with proof of purchase. We reserve the right to inspect returned goods.
- Custom or specially procured parts may have limited return options outside statutory defect/warranty claims.
8. Limitation of Liability
8.1 The Supplier is not liable for any indirect, incidental, or consequential damages arising from the use of the Products, including but not limited to loss of profit, business interruption, or property damage.
8.2 The Supplier’s total liability for any claim related to the Products is limited to the price paid by the Customer for the Products in question.
9. Product Compatibility
9.1 It is the Customer’s responsibility to ensure that the Products are compatible with their vehicle make, model, and specifications.
9.2 The Supplier makes no guarantees regarding the compatibility of the Products unless explicitly stated in the product description.
10. Force Majeure
10.1 The Supplier is not responsible for delays or failures to perform due to events beyond its control, including but not limited to natural disasters, acts of war, government actions, labour disputes, or supplier failures.
11. Governing Law
11.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
11.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Germiston.
12. Intellectual Property
12.1 All trademarks, logos, and intellectual property related to the Products are the property of the respective manufacturers or the Supplier and are protected by applicable intellectual property laws.
13. Amendments
13.1 The Supplier reserves the right to update or modify these Terms at any time. Customers will be notified of any changes, and continued use of the service after such changes constitutes acceptance of the revised Terms.
